1. To Enter: Visit www.soma.com anytime between November 16, 2009 and December 20, 2009, click on the Sweepstakes link, and complete and submit the online registration. Additionally, you may enter by visiting a participating Soma Intimates retail boutique anytime during normal business hours between November 16, 2009 and December 20, 2009, completing an official entry form, and depositing it in the entry box provided. Entries are limited to one (1) per person, per day, per each entry method. Photocopied, mechanically-reproduced, forged, or altered entries and facsimiles are void. Incomplete or illegible entries are not eligible. Entering invalid personal information will result in sweepstakes disqualification. All entries become the property of Soma Intimates, LLC, a subsidiary of Chico's FAS, Inc. ("Sponsor") and will not be returned. Online entries must be submitted and received by 11:59 PM ET December 20, 2009. In-store entries must be received by the close of business on December 20, 2009. Entrants are responsible for determining the corresponding time zone in their respective location.
2. Drawing: Winner will be selected via random drawing on or about January 5, 2010, from among all eligible entries received. Drawing will be conducted in Marblehead, MA by PROMOSIS, INC., an independent judging organization whose decisions in all matters relating to this promotion are final. Potential Grand Prize winner will be contacted by Promosis via US mail or express courier (certified mail if resident of Puerto Rico), and will be required to complete and have notarized an Affidavit of Eligibility and liability/publicity release that must be returned and received within 14 days of the date mailed to potential Grand Prize winner (30 days from receipt of notification, if potential winner is a resident of Puerto Rico), or prize will be forfeited. If potential Grand Prize winner is between 18 and 21 years of age and considered a minor in his/her jurisdiction of residency, the prize will be awarded in the name of the parent/legal guardian, pending timely completion and return of Affidavit by parent/legal guardian as stated herein.
3. Prize: One Grand Prize: A trip to any city in the world for the winner and up to two (2) friends with a $6,000 travel voucher provided by 10Best for travel and accommodations, a $3,000 Soma shopping spree, and $1,000 to help defray taxes. Approximate retail value of the Grand Prize is $10,000. No substitution, cash redemption or cash alternative (except as noted above), or assignment or transfer of prizes permitted, in whole or in part. If the Prize winner declines the prize, fails to claim the prize, is unavailable for prize fulfillment, or fails to abide by these Official Rules, Sponsor may select an alternate winner from all remaining eligible entries. Winner is solely responsible for all applicable federal, state, or local taxes on the value of the prize. Grand Prize winner will be issued an IRS 1099-MISC tax form for the retail value of prize won. Winner is responsible for all costs or expenses related to the acceptance or use of the prize not specifically exempted herein. In no event will more than stated number of prizes be awarded. By accepting a prize, winner agrees to the release of his or her name and/or likeness for potential publicity purposes, where permitted by law. Odds of winning are dependent upon the number of eligible entries received.
4. Eligibility: Sweepstakes is open only to legal residents of the 50 United States, Washington DC, and Puerto Rico (not including residents of all other US Territories and Possessions) who are at least eighteen (18) years of age at the time of entry. Not open to employees of Chico's FAS, Inc., its divisions, subsidiaries, respective affiliates, prize suppliers, advertising and public relations agencies, PROMOSIS, Inc., and their immediate families as well as individuals living in the same households of such employees. Entrants agree to the release of their name, address, and email information to Promosis for winner notification purposes and for public winner disclosure as required by law. First Prize winners agree to allow their first name, last initial, and city and State of residence be posted online by Soma Intimates without prior clearance or permission. By entering the Sweepstakes, you agree to be bound by the Soma Intimates privacy policy. Sweepstakes is void where prohibited, and is subject to all applicable Federal, State, and local laws and regulations. By entering, participants agree to be bound by these official rules.
5. Limitation of Liability: Sponsor and its promotion partners are not responsible for printing or typographical errors in any sweepstakes-related materials; or for any individual's inability to enter the sweepstakes, including but not limited to unavailable network, server, or other connections; failed software or hardware transmissions; other errors of any kind, whether human, mechanical, or electronic, including lost, late, incomplete, damaged, or misdirected entries; or for any damage to any computer related to or resulting from participation. Multiple entries beyond what is specified in section 1, and those that are generated by script, macro, or other automated entry devices are not valid, and will be disqualified. Entries that are tampered-with, forged, illegible, mutilated, altered, mechanically duplicated, or obtained through unauthorized distribution channels are not valid and will be disqualified. Sponsor reserves the right to cancel or modify the promotion should any of the foregoing occurrences corrupt or impair the administration, security, fairness, or proper play of the promotion, as determined by Sponsor in its sole discretion. If the promotion is cancelled for any reason listed above, winners will be determined via random drawing from all eligible entries received up to the time of promotion cancellation. Entrants agree that the Sponsor, its promotion partners, related companies, and agencies, and their respective employees or officers shall not be liable for injury, losses, damages, or costs of any kind resulting from participation in this promotion or acceptance of or use or misuse of a prize or parts thereof.
6. Dispute Resolution: THIS PROMOTION IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE COMMONWEALTH OF MASSACHUSETTS, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this promotion, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this promotion, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Massachusetts having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e. costs associated with entering this promotion), and participant further waives all rights to have damages multiplied or increased.
7. 8. List Removal: To remove your name from future Soma Intimates sweepstakes mailings, call Soma Customer Service at: 866-768-7662, or email request to: customerservice@soma.com. Please allow 45 days for your request to be processed.
